Páramo Website Terms and Conditions of Sale

This page contains the terms and conditions on which we will supply the products (products) listed on our website www.paramo-clothing.com to you.

These terms include some provisions (see Section 12 "Our Liability") that limit our liability to you in the event that we break any of the terms of our contract with you.

Please read these terms and conditions carefully before ordering any products from our site. By placing an order for any of our products, you agree to be bound by these terms and conditions.

Please click on the button marked "I Accept" when asked if you accept these terms and conditions. Please understand that if you refuse to accept these terms and conditions, you will not be able to order any products from our site.

  1. Information about us

    • www.paramo.co.uk and www.paramo-clothing.com are sites operated by Páramo Limited (we, us, our). We are registered in England & Wales under company number 02708706, our registered office is at Unit F, Durgates Industrial Estate, Wadhurst, East Sussex, TN5 6DF, UK and our VAT number is 583879768.

  2. About You

    • We regret that we cannot accept orders from anyone below 18 years of age. By placing an order through our site you confirm that you are at least 18 years old.

  3. How the contract is formed between you and us

    • No contract will exist between you and us until we have received full payment from you and have either (i) given you a written/emailed acceptance of your order or (ii) dispatched the ordered products, whichever is the sooner. Please note that our initial acknowledgement of your order does not constitute acceptance of that order unless we expressly state otherwise.

  4. Unavailability of Products

    • We make every effort to ensure that sufficient products are available in stock to meet your order. However, occasionally we may find that stock is unavailable.

      If we cannot deliver the products you have ordered within 28 days of your order, we will contact you and ask how you wish to proceed. You may either cancel your order for a full refund (including delivery charges), await the arrival of the product in stock (unless we inform you that the product will not be coming back into stock) or change your order to replace the product originally ordered with an alternative product (with a corresponding adjustment in the price if appropriate).

  5. Delivery

    • The delivery charges for your order are calculated in accordance with our delivery rates as set out on our site, and are shown separately on the order confirmation. If items on your order are out of stock we will inform you.

      Our aim is to despatch your order within 5 working days, unless otherwise stated. Please note that all despatch and delivery times are approximate.

      Many products are sent via our approved carrier and must be signed for.

      In the UK: The standard delivery within the UK is a 48 hour service sent via our chosen courier, so orders should be with you within 7 working days. However, delivery times can increase to remote areas of the UK Mainland and outside the UK mainland.

      In Europe: Please allow 7-10 working days for delivery. European Orders are sent via our chosen courier service.

      For International Orders outside Europe: Please allow up to 14 working days for delivery. International Orders are sent via our chosen courier service.

      In all cases, if our carrier is unable to deliver the products to the Delivery Address, they will be either
      (i) available for collection from our carrier's local depot in the Delivery Address area
      or
      (ii) returned to our Head Office at Wadhurst, UK.

      If a further delivery is required, it may incur an additional delivery fee, which we will notify to you in advance. We will not make any further attempt at delivery until you have agreed to any additional fee. If you do not wish to incur that additional fee then you may cancel your order for a full refund (see Section 7, "Cancellation by You").

  6. Prices and payment

    • The price of any products will be as quoted on our site:

      • Prices on our UK site include VAT but exclude delivery costs, which will be added to the Total Amount Due.
      • Prices on our EU sites exclude both VAT and delivery costs. All consignments shipped to an EU address will be dispatched Delivery Duty Paid and any Customs & Duties payable on delivery will be paid by Páramo.
      • Prices on our international site exclude both VAT and delivery costs. Any Customs & Duties payable on delivery are also not included and Páramo Ltd cannot be held liable for any charges imposed.

      Our site contains a large number of products and is always possible that, despite our best efforts, some of the products listed on our site may be incorrectly priced. If, for whatever reason, your order for purchase is not showing the correct price for the goods, we will inform you that the price is incorrect and advise you of what action needs to be taken. We reserve the right to reject your offer to purchase the products in these circumstances.

      Payment for the products is due at the same time as you place your order. No products will be dispatched until you have paid us in full for the corresponding order.

      Payment is made using our payment processor (Adyen). By placing your order, you agree that we may pass on your details and the details of your order to our payment processor in order to enable your payment to be processed.

  7. Cancellation by you

    • You have the right to cancel any order by giving us notice of cancellation at any time up to 14 days after delivery of the products in that order.

      If you have already received the products, or if you receive the products after giving us notice of cancellation, then you must return the products to us in their original condition and with their original packaging, using the procedures set out in our Returns and Exchanges information shown here.

      Please allow 30 days for any refund payments to be made.

      If you wish to exercise your right to cancel, please contact us as soon as possible.

  8. Cancellation by us

    • We reserve the right to decline or cancel any order prior to delivery.

      Examples of when we might do so include:

      • where products you have ordered are out of stock; or
      • where we have made an error in the description or pricing of any products you have ordered; or
      • if we believe you are under 18; or
      • if the delivery address or billing address for the products is outside the UK and you are paying in £Sterling.

      If we decline or cancel an order we will refund all amounts paid by you in respect of that order.

  9. Problems with products at delivery

    • If any products are damaged on arrival, then please notify this to the carrier at the time if possible.

      Please also contact us to report the damage (even if you have been able to notify the carrier) and return the products to us in accordance the procedures set out in our Returns and Exchanges information shown here. We will then make arrangements with you for delivery of replacement products or a full refund.

  10. Returns policy

    • Any products that are to be returned to us must be returned in accordance with the information set out in our Returns and Exchanges information shown here. The version of the returns information that applies will be the version in force at the time the return is made. Failure to comply with this policy may delay processing of your return and of any refund, repair or replacement.

  11. Data Protection

    • We take your privacy very seriously. Please see our Privacy Policy for more details of how we use your data.

  12. Our liability

    • If we break the terms of this contract, our liability for losses you suffer as a result is strictly limited to the purchase price of the product you purchased and any losses which are a foreseeable consequence of us breaking the contract. Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us.

      These terms do not limit in any way our liability:

      • for death or personal injury caused by our negligence;
      • under section 2(3) of the Consumer Protection Act 1987;
      • for fraud or fraudulent misrepresentation; or
      • for any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

      The above terms do not affect your statutory rights.

  13. Events outside our control

    • We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under this contract that is caused by events outside our reasonable control.

  14. Páramo authorised reseller

    • These terms and conditions are intended for use with consumers. If you are purchasing products via our site in your capacity as a retailer (including a Páramo Authorised Reseller) you will not have the benefit of the provisions set out above (including those regarding order cancellations and refunds) and the Páramo Authorised Reseller Agreement (or such other sale terms as we have agreed with you in writing) will apply.

  16. Contacting you

    • We may contact you by telephone, email or post, using the contact details you provide to us. It is your responsibility to inform us promptly if any of your contact details change.

  17. General

    • If any term of these terms and conditions is found to be invalid or unenforceable by any court or other such authority, then this term will be removed from these terms and conditions. All other terms will continue in force.

      We reserve the right to vary these terms and conditions at any time without notice to you. However you will be subject to the terms and conditions in force at the time you order products from us.

      Any contract made under these terms and conditions will be governed by English law.
